Holding Deposit & Tenant Application Terms
You will be required to pay a holding deposit equivalent to one week's rent (you may calculate this by dividing the annual rent amount by 52) to our bank account, details of which will be emailed to you.
Your holding deposit will be retained until the deadline of application. The deadline of application ends on the fifteenth day of the period beginning with the day on which we receive the holding deposit. We will not agree to extend this deadline.
Your holding deposit will be returned to you unless one of the following applies (forfeiture terms), in which case you will forfeit your holding deposit in full:
- We are prohibited by Section 22 of the Immigration Act 2014 (person disqualified by immigration status) from granting a tenancy of the housing to the tenant.
- If the tenant, occupants, their guarantor or any referees supplied in support of the tenant, occupants or guarantor provides false or misleading information. We will not grant a tenancy if any false or misleading information has been provided. For the avoidance of doubt, any relevant information omitted from this form will be deemed as misleading.
- Any tenant named in this form notified the letting agent or landlord before the deadline for the agreement that the tenant has decided not to enter into a tenancy agreement.
- Any tenant named in this form fails to take all reasonable steps to enter into a tenancy agreement, including submitting any requested information or carrying out tasks related to the vetting process which includes cooperating with third-party organisations.
If the above does not apply, your holding deposit will be returned to you if:
- The agent or landlord decides not to grant a tenancy and the forfeiture terms do not apply.
- The agent or landlord grants a tenancy.
- If the agent or landlord fails to enter into an agreement before the deadline of application and the forfeiture terms do not apply.
Where the forfeiture terms do not apply, your holding deposit will be returned to you within 7 days of a tenancy being granted or of the date the landlord or agent decides not to grant a tenancy or the deadline of agreement, whichever is sooner.
Where the forfeiture terms do apply, we will provide to you in writing via email a notice explaining why we intend not to repay the holding deposit within the relevant period.
The holding deposit is payable by the person named under the "Your Details" section of this form and they remain fully responsible and liable for the actions, information and level of cooperation of any and all occupants, tenants, guarantors and other relevant people named on this form. For the avoidance of doubt, your holding deposit will be forfeited if the forfeiture terms apply to any person or organisation named on this form by the tenants, occupants or guarantors.
The holding deposit should be paid within 4 hours of submitting your application to the account details emailed to you (check your spam folder) until this deposit is received, we will not process your application. Outside of this 4 hour period, we may reject this application allowing us to accept another tenant application. Any funds paid outside of this 4 hour period will be unsolicited and subject to a returned payment fee. We may agree in writing to extend this 4 hour period at our discretion.
Upon submitting this application, you agree for the details contained within this application to be shared with third-party organisations, the owners of the property and any other relevant parties in line with our privacy policy, full details of how we manage and process your data can be found in our privacy policy and terms of use located via a link at the bottom of any page on our website.
